Buying luxury property in Rio de Janeiro as a foreigner

A practical overview of CPF registration, foreign exchange, due diligence, taxes and closing.

1. Can a foreigner buy urban property in Brazil?

Foreign individuals can generally acquire urban real estate in Brazil. Rural and certain restricted areas follow different rules. Obtain independent legal advice for the specific asset.

2. Obtain a CPF

A CPF taxpayer number is required for acts involving registered property. Foreign residents abroad should confirm the current procedure with the Brazilian Federal Revenue Service or a Brazilian consulate.

3. Structure the transfer of funds

Use a financial institution authorized to operate in the Brazilian foreign-exchange market. Keep complete records of the remittance, conversion and destination of funds.

4. Carry out legal due diligence

Your lawyer should review the title certificate, liens, seller documentation, condominium liabilities, property taxes and any powers of attorney before a binding commitment.

5. Taxes, deed and registration

The transaction may require transfer tax, a public deed and registration with the competent Real Estate Registry. Ownership is transferred by registration, not merely by signing a purchase agreement.
